Acceptance of Terms

By accessing or using Shorts Daily, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

Service Description

Shorts Daily is an AI-powered platform that enables users to:

  • Generate short-form videos from ideas or scripts using artificial intelligence
  • Customize videos with various styles, voices, music, and effects
  • Connect YouTube and social media accounts for automated publishing
  • Schedule videos for automated uploads
  • Participate in an affiliate program to earn commissions
  • Purchase credits and subscribe to premium plans

Account Requirements

  • Age Requirement: You must be at least 13 years old to use Shorts Daily. Users under 18 should have parental consent.
  • Account Accuracy: You must provide accurate information when signing up via Google OAuth.
  • One Account Per User: Each user is permitted one account. Multiple accounts may result in suspension.
  • Account Security: You are responsible for maintaining the security of your account credentials and all activities under your account.

User Obligations

When using Shorts Daily, you agree to:

  • Comply with all applicable laws and platform policies
  • Not create illegal, harmful, defamatory, or infringing content
  • Not abuse our API, services, or attempt to bypass rate limits
  • Respect intellectual property rights of others
  • Not engage in spam, automated abuse, or bot-like behavior
  • Not use the service to generate misleading deepfakes or harmful misinformation
  • Not resell or redistribute our service without authorization

Content & Intellectual Property

Your Content Rights

You retain all ownership rights to the content you input (scripts, prompts, ideas). By using our service, you grant Shorts Daily a limited license to process your content solely for the purpose of generating videos and providing our services.

AI-Generated Content

Content generated by our AI models (scripts, images, voiceovers) is provided to you for your use. However, you acknowledge that AI-generated content may have complex intellectual property implications. You are responsible for:

  • Ensuring your use of AI-generated content complies with platform policies (YouTube, TikTok, etc.)
  • Verifying AI outputs do not infringe on third-party rights
  • Understanding that AI models may produce similar outputs for different users

Music & Third-Party Assets

If you use music or other third-party assets in your videos, you are solely responsible for ensuring you have proper licensing. Shorts Daily is not liable for copyright claims resulting from your use of unlicensed content.

Prohibited Content

You may not create or distribute content that is:

  • Illegal, fraudulent, or deceptive
  • Violates intellectual property rights
  • Contains hate speech, harassment, or violence
  • Sexually explicit or exploits minors
  • Promotes dangerous or harmful activities

Credits & Billing

Credit System

  • New users receive 30 trial credits upon signup
  • Idea generation costs 5 credits per generation
  • Video rendering costs vary based on quality, duration, and features
  • Credits are consumed immediately when services are rendered

Subscriptions & Payments

  • Subscription plans (Free, Pro, Enterprise) include monthly credit allowances
  • Additional credits can be purchased via credit packs (Small, Medium, Large)
  • Payments processed via Dodo Payments
  • Subscriptions renew automatically unless cancelled
  • You can cancel subscriptions anytime via the billing page

Refund Policy

  • Consumed credits: No refunds for credits that have been used to generate content
  • Subscription grace period: 7-day refund window for new subscriptions if no credits have been consumed
  • Service failures: Credits may be refunded if our service fails to deliver the promised functionality

YouTube & Social Media Integration

When you connect your YouTube or other social media channels:

  • OAuth Permissions: You grant Shorts Daily permission to upload videos to your connected channels on your behalf
  • Platform Compliance: You remain responsible for ensuring your content complies with YouTube's Terms of Service and Community Guidelines
  • No Liability: Shorts Daily is not liable for strikes, bans, or account suspensions resulting from content you publish via our platform
  • Paid Feature: Automated upload and scheduling features are available to paid subscribers only
  • Revocable: You may disconnect your channels at any time via settings

Affiliate Program

Commission Structure

  • Affiliates earn 30% commission on referred user subscriptions
  • Referral links expire after 30 days of inactivity
  • Commissions paid via PayPal only
  • Minimum payout thresholds apply

Prohibited Practices

Affiliates must not:

  • Engage in spam or unsolicited marketing
  • Use misleading advertising or false claims
  • Self-refer or create fraudulent referrals
  • Violate advertising platform policies

Violations may result in commission forfeiture and affiliate account termination.

Disputes

Commission disputes can be submitted via the affiliate dashboard and will be reviewed within 14 business days.

Service Availability

  • No Uptime Guarantee: We strive for high availability but do not guarantee uninterrupted service
  • Maintenance: We may perform scheduled maintenance with advance notice
  • Third-Party Dependencies: Our service relies on third-party AI providers (OpenAI, ElevenLabs, etc.). Outages or limitations from these providers may affect our service

Limitations of Liability

SHORTS DAILY IS PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND

  • No Quality Warranty: We do not guarantee the quality, accuracy, or suitability of AI-generated content for your specific purposes
  • Platform Actions: We are not liable for actions taken by YouTube, TikTok, or other platforms against your account
  • Third-Party Outages: We are not responsible for failures or limitations of third-party AI services
  • Maximum Liability: Our total liability is limited to the amount you paid us in the 12 months preceding any claim
  • Indirect Damages: We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption

Indemnification

You agree to indemnify and hold harmless Shorts Daily from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service
  • Content you create or publish
  • Your violation of these Terms
  • Your violation of third-party rights

Termination

By You

You may delete your account at any time via settings. All your data will be permanently removed (cascade delete) within 30 days.

By Shorts Daily

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Create prohibited content
  • Abuse the service or other users

Effect of Termination

  • Active subscriptions will be cancelled (no prorated refunds for time remaining)
  • Unused credits will be forfeited
  • All your data will be deleted per our retention policy
  • Outstanding affiliate commissions will be paid out if above minimum threshold

Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the United States
  • Informal Resolution: We encourage contacting us at support@shortsdaily.com to resolve disputes informally before pursuing legal action

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of Shorts Daily after changes constitutes acceptance of the updated Terms.
